MightyS ("we", "us", "our") is a small mobile app studio. These Terms of Service ("Terms") are a legal agreement between you and MightyS covering our apps and games for iOS and Android, together with their websites and related services (the "Apps").
These Terms apply to every MightyS app and game unless that app publishes its own dedicated terms, in which case the dedicated terms take precedence for that app. Our privacy practices are described separately in the standard Privacy Policy and the Ad-Supported Apps Policy.
By downloading, installing, or using any of the Apps you agree to these Terms. If you do not agree, do not use the Apps. If you use the Apps on behalf of someone else (for example a child you are the guardian of), you agree to these Terms on their behalf as well.
Your use of the Apps is also subject to the terms of the store you installed them from: the Apple App Store on iOS and Google Play on Android. Where a store's terms are stricter, the store's terms apply.
The Apps are casual games, puzzles, and utility apps designed to work offline-first: your progress and saves are stored on your own device unless an app clearly states otherwise (for example an opt-in online leaderboard). We may update, change, or discontinue any App or feature at any time. We aim to never take away something you paid for; if an App is discontinued, its already-installed copies keep working as they are.
Some Apps offer optional in-app purchases, such as supporter packs, cosmetic items, or virtual currency. All purchases are processed by Apple or Google, not by us; refunds are governed by the respective store's refund policy, and we do not receive or store your payment details.
Virtual items and virtual currency have no real-world monetary value, are licensed to you for use inside the App (not sold), cannot be exchanged for money, and may not be transferred outside the App. Purchases are consumed inside the game they were made in.
Some Apps are free and supported by advertising. Where rewarded ads exist they are always optional: you choose to watch them in exchange for an in-game benefit. How ads and ad partners handle data is described in the Ad-Supported Apps Privacy Policy.
You agree not to:
(a) cheat, exploit bugs, or tamper with scores, saves, or online leaderboards; (b) decompile, reverse engineer, or modify the Apps except where the law expressly permits it; (c) use the Apps for anything unlawful; (d) resell, rent, or redistribute the Apps or their content; (e) interfere with the operation of our services or other players' use of them.
We may remove manipulated leaderboard entries and block abusive clients from online features to keep play fair for everyone.
The Apps, including their code, artwork, names, logos, game content, and sounds, are owned by MightyS or our licensors and are protected by copyright and other laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Apps for your own entertainment on devices you own or control. No other rights are granted.
The Apps are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not promise that the Apps will be uninterrupted, error-free, or available at all times. Game content (scores, prices, statistics, fictional economies) is entertainment, not advice.
To the maximum extent permitted by law, MightyS is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, progress, or virtual items, arising from your use of the Apps. Our total liability for all claims relating to an App is limited to the amount you paid us for that App in the twelve months before the claim, or ten euros if you paid nothing. Nothing in these Terms limits liability that cannot be limited by law, and nothing affects the statutory rights you have as a consumer.
You can stop using the Apps at any time by uninstalling them. We may suspend or end access to online features (such as leaderboards) if you materially breach these Terms. Sections that by their nature should survive (intellectual property, disclaimers, limitation of liability, governing law) survive termination.
We may update these Terms from time to time, for example when we add new features or when the law changes. The "Last updated" date at the top always reflects the current version, and material changes will be announced inside the affected Apps or on this page. Continuing to use the Apps after a change means you accept the updated Terms.
These Terms are governed by the laws of the Republic of Serbia, without regard to conflict-of-law rules. If you are a consumer in the EU/EEA or UK, you also keep the protection of the mandatory consumer laws of your country of residence, and you may bring proceedings in your local courts where the law gives you that right.
